Daekyo America, Inc. (“Daekyo,” “Eye Level,” or “Sponsor”) is a franchisor that conducts business through franchising after-school learning centers in the United States and Canada. Daekyo licenses to franchisees a proprietary system of learning, curriculum, marketing and the right to use Daekyo’s trademarks pursuant to a franchise agreement. Franchisees of Daekyo open and operate Eye Level Learning Centers in their local communities, usually in strip-mall space and are independently owned and operated.

The Event or Competition - Oratacular
The Oratacular (the “Event” or “Competition”) is a totally skill-based Event. It is open to any child who is in grades 1st - 8th in the U.S. and Canada and (ii) can attend a registered center to participate. Please see our website, http://www.oratacular.com where parents can learn more about the Event, including registering your child. Each student (“Participant”) will prepare their speech according to the provided materials and topic. Parents, please contact the registered center for specific date and time. Students will compete with other participants at the registered center. Prizes and awards will vary per location, so speak with the Center Director of your registered center to learn more.
Currently enrolled Eye Level students must register and attend the event at the center in which they are enrolled for Eye Level classes.
Online Registration Required
You must register your child online for the event. Registration for the event is free of charge. We will not accept registrations on the day of the Event. The Event is open to U.S. and Canada legal residents who are in 1st – 8th grade at the time of the event (March 2023).
Agreement of Official Rules and Releases
By enrolling in the Oratacular, Parent and Participant fully and unconditionally agree to and accept these Official Rules and the final decisions of the Sponsor. Sponsor reserves the right to disqualify any Participant if these Official Rules are not followed. Participants must be registered online before the registration deadline to participate.
You agree to waive, discharge claims, and Release the Event from all liability and indemnify and hold harmless Sponsor, Sponsor’s organizers, hosts, subsidiaries, affiliates, volunteers and other partners and employees, from any and all liability on account of, or in any way resulting from injuries and damages in any way connected with the Oratacular. Parent and Participant agrees that this assumption of risk and release of liability is binding upon you and your heirs, executors, agents, administrators, and assigns, and include any minors accompanying Parent or Participant at the Event.
Parent agrees that Participant may be photographed at the Event, and agrees to allow the Event hosts, Sponsor, organizers, and partners to use any Participant’s photo, video, or film likeness for any business or marketing purpose of Sponsor.
Privacy Policy When Registering and Data Collection Policy
Eye Level does not provide any personally identifying information, regardless of its source, to any third party for any purpose whatsoever unless disclosed prior to or during collection. Eye Level will share the registration data with the Eye Level franchised center in which the Participant is registered to participate in the Event. Eye Level will also share the names and email addresses of Gold winners with our parent company, Daekyo, Co. Ltd.
Individuals Under 13. No information should be submitted to or posted on the site by users under the age of 13 years without the consent of their parent or guardian. Users under the age of 13 are generally asked not to participate in promotional opportunities.
Individuals 13 through 17. Eye Level requests that children under the age of 18 do not submit or post information to the site without a parent or guardian’s consent.
Information Collected by http://www.oratacular.com. The website http://www.oratacular.com collects two types of personally identifying information from users: personal data (such as names and email addresses); and aggregated data (such as information about traffic patterns on http://www.oratacular.com , for example how many users log into on a daily basis).

Personal Data. Personal data is collected when users provide personal data to http://www.oratacular.com (hereafter, "the website") , for example in registering for electronic newsletters or other membership services, in answering surveys, and registering for contests and other promotional opportunities provided by http://www.oratacular.com. Also, we collect the email addresses of users who send messages to our website administrator or post messages to any of our message boards and chat areas.
By registering for the Event, you consent to recieve marketing communications from Eye Level. You can opt out of receiving these communications at any time by contacting eventusa@myeyelevel.com or following the unsubscribe instructions containted in the communications themselves.
Aggregated Information.
Aggregated information, such as which pages users access or visit and information volunteered by users, such as survey information and/or site registrations, is collected through various methods. For example, the website collects IP addresses. An IP address is a number that is automatically assigned to your computer whenever you are surfing the Web. Web servers, the computers that “serve up” Web pages, automatically identify your computer by its IP address, and when you request a page from our website our servers log your IP address. The website does not link IP addresses to anything personally identifiable, so although your session will be logged, you will remain anonymous to us. The website collects IP addresses for the purposes of system administration and to provide aggregate data to advertisers about the volume of use on the website.
Use of Cookies

Objection to Use of Data
If you object to the use of personal information provided by you for any reason, you may stop that use by modifying your registration information online. If you have subscribed to any service through the website and/or you receive any communication from us that you no longer wish to receive, please discontinue associated subscriptions by contacting eventusa@myeyelevel.com, or by following any relevant instructions provided at the time you registered for the service or within the communication itself.

No transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties not under the control of Eye Level to intercept or access transmissions or private communications unlawfully. While we strive to protect your personal information, Eye Level cannot ensure or warrant the security of any information you transmit to us. Any such transmission is done at your own risk.
